Terms of Service

1. Acceptance of Terms

By accessing and using the SCUB (Sports Club University of Bolzano) website and services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and SCUB, governed by Italian law. If you do not agree to abide by these Terms, please do not use this service.

Applicable Law: These Terms are governed by Italian law and any disputes shall be subject to the exclusive jurisdiction of the Italian courts in Bolzano, Italy.

2. Description of Service

SCUB provides a platform for University of Bolzano students to:

• Create an account and see their SCUB membership status
• Register for sports events and activities (members only)
• Book a spot at parties and social events (booking is free)
• Chat with other participants and members
• Access member-exclusive content and benefits

3. User Accounts and Registration

To access certain features of our service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Membership and Eligibility

SCUB membership is available to:

• Current students of the University of Bolzano
• Faculty and staff members of the University of Bolzano
• Alumni of the University of Bolzano (subject to approval)
• External members who are not part of unibz (subject to approval)

Memberships are sold in person only, at the SCUB stands on campus; there is no online purchase. Your website account is activated automatically when its university email or student ID matches the club's membership roster. External members are activated when they register with the exact email written on their membership form. We may verify your student status.

5. Event Bookings and Payments

• Booking on the website is free. No payments are made online.
• For paid events and parties, the price shown is paid in person.
• Bookings are subject to availability; when an event is full you may be placed on a waitlist.
• Online bookings close 30 minutes before the event starts.
• You can cancel a booking (or leave a waitlist) online any time before the event starts. Please cancel as early as you can so someone on the waitlist gets your spot.
• We may cancel or reschedule events (for example because of bad weather). Everyone booked is notified on the website, and a cancelled event stays listed with the reason.

6. User Conduct

You agree not to use our service to:

• Violate any laws or regulations
• Infringe on the rights of others
• Transmit harmful or malicious content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of our service
• Use the service for commercial purposes without permission
• Book events with bots, scripts or other automated tools, or try to get around the human check: bookings must be made by the person attending
• Create more than one account, or share your account or ticket with someone else

7. Intellectual Property

The SCUB website and its content, including but not limited to text, graphics, logos, images, and software, are the property of SCUB and are protected by copyright and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

9. Limitation of Liability

SCUB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Italian Law Compliance: This limitation of liability is subject to mandatory provisions of Italian law, including but not limited to consumer protection laws and provisions that cannot be excluded by contract. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Italian law.

10. Termination

We may suspend or close your account, and cancel its bookings, if you breach these Terms or misuse the service (for example by booking with automated tools). Where possible we will tell you why. You can ask us to close your account at any time by writing to scub@unibz.it.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

12. Italian Law and Jurisdiction

These Terms of Service are governed by Italian law, including but not limited to:

• Codice Civile Italiano (Italian Civil Code)
• D.Lgs. 206/2005 (Italian Consumer Code)
• D.Lgs. 196/2003 and GDPR (Data Protection)
• D.Lgs. 70/2003 (E-commerce regulations)

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent Italian courts in Bolzano, Italy, without prejudice to the mandatory rules protecting consumers.
