1. Acceptance of Terms
By accessing and using the SCUB (Sports Club University of Bolzano) website and services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") constitute a legally binding agreement between you and SCUB, governed by Italian law. If you do not agree to abide by these Terms, please do not use this service.
Applicable Law: These Terms are governed by Italian law and any disputes shall be subject to the exclusive jurisdiction of the Italian courts in Bolzano, Italy.
2. Description of Service
SCUB provides a platform for University of Bolzano students to:
- Join the sports club and become a member
- Register for sports events and activities
- Book tickets for parties and social events
- Participate in quizzes and competitions
- Access member-exclusive content and benefits
3. User Accounts and Registration
To access certain features of our service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
4. Membership and Eligibility
SCUB membership is available to:
- Current students of the University of Bolzano
- Faculty and staff members of the University of Bolzano
- Alumni of the University of Bolzano (subject to approval)
We reserve the right to verify your student status and may request additional documentation to confirm your eligibility.
5. Event Bookings and Payments
When booking events or purchasing tickets:
- All bookings are subject to availability
- Payment must be completed within the specified deadline
- Refunds are subject to our cancellation policy and Italian consumer law
- We reserve the right to cancel events due to unforeseen circumstances
- Event details may be subject to change with reasonable notice
- All prices include applicable Italian VAT (IVA) where required
- Payment processing is handled securely in compliance with PCI DSS standards
Right of Withdrawal: In accordance with Italian consumer law (D.Lgs. 206/2005), you have the right to withdraw from distance contracts within 14 days of purchase, subject to specific conditions for event tickets.
6. User Conduct
You agree not to use our service to:
- Violate any laws or regulations
- Infringe on the rights of others
- Transmit harmful or malicious content
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of our service
- Use the service for commercial purposes without permission
7. Intellectual Property
The SCUB website and its content, including but not limited to text, graphics, logos, images, and software, are the property of SCUB and are protected by copyright and other intellectual property laws.
8. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.
9. Limitation of Liability
SCUB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.
Italian Law Compliance: This limitation of liability is subject to mandatory provisions of Italian law, including but not limited to consumer protection laws and provisions that cannot be excluded by contract. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Italian law.
10. Termination
We may terminate or suspend your account and access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
12. Italian Law and Jurisdiction
These Terms of Service are governed by Italian law, including but not limited to:
- Codice Civile Italiano (Italian Civil Code)
- D.Lgs. 206/2005 (Italian Consumer Code)
- D.Lgs. 196/2003 and GDPR (Data Protection)
- D.Lgs. 70/2003 (E-commerce regulations)
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent Italian courts in Bolzano, Italy. For consumer disputes, you may also use the European Online Dispute Resolution platform atec.europa.eu/consumers/odr.
